PURISH CLUB LOYALTY PROGRAM TERMS AND CONDITIONS

1. PREAMBLE
The purpose of these General Terms and Conditions (hereinafter "GTC") is to regulate the rights and obligations of PURISH GmbH, Alt-Moabit 90, 10559 Berlin, Germany (hereinafter "we" or "us"), the operator of the loyalty program offered via https://www.purish.com/ (hereinafter "Website") (hereinafter "PURISH Club") and the customers participating in the PURISH Club (hereinafter the "Members", "you", "you").
The PURISH Club is a loyalty program that allows members who have registered for a customer account on the website and wish to participate in the loyalty program to collect points. These Terms and Conditions describe how members can participate in the loyalty program, receive certain benefits, and collect points for each purchase and other interactions with us, as specified in the loyalty program, and redeem them for rewards and other benefits.
2. PARTICIPATION IN THE PURISH CLUB
Acceptance of these Terms and Conditions requires the conclusion of an electronic contract, which is concluded free of charge, in order to participate in the PURISH Club.
By participating in the PURISH Club, the member agrees to these terms and conditions without reservation.
We may change these Terms and Conditions or modify or terminate the Loyalty Program (or any part thereof) at any time, particularly due to changes in legal regulations. If a change materially affects the member's rights or obligations, the member will be notified of these changes in advance. Continued use of the Loyalty Program constitutes the member's consent to any modification, revocation, or addition to these Terms and Conditions by us. The Terms and Conditions in effect at the time the user visits the website apply.
3. TERM
You will benefit from the advantages of the PURISH Club from the date you join the PURISH Club for an indefinite period of time, subject to termination by you or us, particularly in the event of non-compliance with the provisions of these Terms and Conditions.
4. PURISH CLUB MEMBERSHIP ACCOUNT
Use of the PURISH Club is reserved for private use by consumers within the meaning of Section 13 of the German Civil Code (BGB); use for commercial or other business purposes is prohibited.
To access the PURISH Club, you must create a customer account on the website.
i) By creating a customer account, you agree and confirm that: if you are under 18 years of age, you have the permission of a parent or guardian;
ii) you are able to enter into and perform your obligations under these Terms and Conditions;
iii) you have not registered more than one customer account, nor have you registered or created a customer account in the name of another person, or maintain a customer account that is otherwise false or misleading;
iv) you do not transfer the customer account to another (legal) person;
v) ensure the security of your username, password and other confidential information relating to your customer account;
vi) notify us immediately if you become aware of or suspect that your Customer Account has been used in an unauthorized manner or if there has been a (potential) breach of security, including loss or theft of the password for your Customer Account;
vii) in the event of unauthorized use, you will take the necessary measures to prevent unauthorized use of your customer account, for example, by contacting us or changing your login details;
viii) you will not access or attempt to access another person's account, password or personal information or otherwise violate any person's privacy;
ix) you will update and keep your account information up to date, including all email addresses, postal addresses and any other contact or personal information we need to create your customer account;
x) that we are not responsible for any errors resulting from incorrect or inaccurate information provided by you;
xi) comply with all reasonable and legitimate instructions given by us from time to time regarding Members' access to and use of the Site;
and
xii) you will not engage in any malicious conduct when using the Platform, including any conduct that is directed at or that disrupts the functionality, integrity and functioning of the Platform.
You acknowledge and agree that we may take any necessary action, including suspending or terminating your access to your Customer Account and the Website without prior notice, if:
i) we consider it necessary to protect our rights in the PURISH Club under these Terms and Conditions;
ii) we consider it necessary in connection with the performance of other contracts to which we are party;
iii) you have violated these Terms and Conditions when using your customer account and the points and benefits received under the PURISH Club and we have a legitimate interest in terminating the contract with you;
iv) you have used the Website unlawfully;
v) we have reasonable grounds to suspect that there is undesirable activity in connection with the customer account.
You agree to use your customer account in accordance with the terms of these Terms and Conditions. We reserve the right to reject or remove any content, data, or information you post or upload to the Website that is deemed offensive, illegal, malicious, or discriminatory.
5.1. Collecting and redeeming loyalty points
i) Members will receive 250 loyalty points for creating their customer account on the Website.
ii) Members receive 50 loyalty points when they sign up for our newsletter.
iii) Members will receive 10 loyalty points for each full euro they pay in total for each order placed on the website.
iv) Members who follow us on our social media channel Instagram will receive a one-time 25 loyalty points.
v) Members who submit a product review for a product purchased on the website will receive 50 loyalty points. The review must be submitted via the member's PURISH customer account on the website. The review can only be submitted via email notification.
vi) Members receive 500 loyalty points if they send a link they receive from us to their friends, family, and acquaintances, if they create a customer account on the website using the link, and if the first order through this customer account with an order value of at least EUR 50.00 is successfully processed. If a member has received such loyalty points, we may deduct these loyalty points if the order for which the member received 500 loyalty points cannot be successfully processed, in particular if the order is not paid in full or if the order is effectively canceled.
vii) If a member has communicated their date of birth to us via their customer account or on the PURISH Club overview, they will receive 500 points on their birthday at the Silver level and 1,000 points at the Gold level. This does not apply if there are less than 30 days between the communication of the date of birth and the first calendar day of the month in which the birthday occurs. Members can redeem their loyalty points for voucher codes that can only be used for orders on the website ( https://www.purish.com/ ). A minimum of 500 loyalty points must be redeemed for one voucher code. The voucher code therefore has a minimum value of EUR 5.00. For example, voucher codes with a value of EUR 10.00 or 20.00 are also available if members redeem 1,000 or 2,000 of the loyalty points earned under these Terms and Conditions.
viii) Voucher codes purchased through the PURISH Club can only be redeemed if the value of the order for which the voucher code is used is at least EUR 55.00. This means, for example:

For a voucher code of EUR 5.00, the minimum order value is EUR 55.00.

For a voucher code of EUR 10.00, the minimum order value is EUR 60.00,

For a voucher code of EUR 20.00, the minimum order value is EUR 70.00.
ix) After three purchases, members are entitled to a level-dependent discount on their next order. This means: Silver-level members receive a 15% discount, redeemable from €70; and Gold-level members receive a 20% discount, redeemable from €90.
5.2. No cash value or transferability
Points do not constitute ownership, do not entitle a member to any right or interest in ownership, and have no cash value. Therefore, points cannot be exchanged for cash or transferred for any reason whatsoever, including in the event of death, personal relationships, or other legal reasons. The sale of points is strictly prohibited, and we may terminate the account of any member who attempts to sell points. Any points remaining in the member's account after termination of the loyalty program will be forfeited without compensation to the member. Points may not be transferred or assigned to any other loyalty programs we may have, unless we expressly determine otherwise at our sole discretion.

7. DATA PROTECTION
We collect personal data from you as part of the processing of the agreements concluded with you. You can find our privacy policy here .
8. TERMINATION/BLOCKING
You can terminate your participation in the PURISH Club at any time, without giving reasons, with effect for the future by deleting your customer account. Deleting your customer account will result in the loss of all your PURISH Club benefits. In particular, you will no longer be able to collect or redeem points or receive any other benefits associated with your participation in the PURISH Club.
We reserve the right to permanently suspend or deactivate your customer account and, if applicable, revoke any associated benefits if you violate any of the provisions of these Terms and Conditions. You will not be entitled to any compensation in this case.
9. LIMITATION OF LIABILITY
We shall be liable without limitation if the cause of the damage is based on an intentional or grossly negligent breach of duty by us or one of our legal representatives or vicarious agents.
Furthermore, we are liable for the slightly negligent breach of essential contractual obligations, the breach of which jeopardizes the achievement of the contract's purpose, or for the breach of obligations whose fulfillment is essential for the proper execution of the contract and on whose compliance you regularly rely. In this case, however, we are only liable for foreseeable, contract-typical damages. We are not liable for the slightly negligent breach of obligations other than those mentioned in the preceding sentences.
The above limitations of liability do not apply in cases of injury to life, body, or health, in cases of assumption of a guarantee, or in cases of fraudulently concealed defects. Liability under the Product Liability Act remains unaffected.
To the extent that our liability is excluded or limited, this also applies to the personal liability of our employees, legal representatives and bodies as well as our vicarious agents.
10. COMPLAINT/ DISPUTE RESOLUTION
The EU Commission provides a platform for out-of-court dispute resolution. This gives consumers the opportunity to resolve disputes related to their online orders without initially involving a court. The dispute resolution platform can be accessed via the external link http://ec.europa.eu/consumers/odr/ . We do not participate in dispute resolution proceedings before a consumer arbitration board. 11. FINAL PROVISIONS
We may transfer or assign the rights arising from these Terms and Conditions or any part thereof to any third party without further notice to the Member.
You may not assign or transfer any rights, benefits, or obligations under these Terms without our prior written consent.
Any invalid or unenforceable provisions of these Terms shall not affect the validity of the remaining provisions of these Terms, which shall remain in full force and effect.
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice of law applies only to the extent that the protection granted is not withdrawn by mandatory provisions of the law of the country in which the consumer has his or her habitual residence.
If the member is a merchant, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from contractual relationships between the member and us is the registered office of PURISH GmbH.
